INCREASED USE
OF 'ORPHAN WORKS' MAY BE PERMITTED
AAM’s Ember Farber and Gail Ravnitzky Silberglied
report that the House Judiciary Subcommittee on the Courts, the
Internet and Intellectual Property recently held a hearing on the
issue of "Orphan Works," copyrighted works whose owners
are difficult or impossible to locate. Legislation is being prepared—and
may be introduced this spring—to allow better use of and access
to such orphan works after conducting reasonably diligent efforts
to identify and find copyright holders.
Such legislation has previously advanced in Congress but has never
become law. Currently, museums are unlikely to exhibit orphan works
to avoid potential liability and adverse publicity.
